DECISION & ORDER ON MOTION

Motion by the appellant on an appeal from a judgment of the Supreme Court, Suffolk County, rendered January 25, 2005, to unseal an envelope in the original papers containing, inter alia, the jury's notes to the trial court, and an envelope in the original papers containing the minutes of the grand jury proceeding in the above-entitled action held on November 12, 2003.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the branch of the motion which is to unseal the envelope containing, inter alia, the jury's notes is denied as academic, as that envelope was not sealed and the respondent has provided the appellant with copies of the contents of that envelope; and it is further,

ORDERED that the branch of the motion which is to unseal the envelope containing the minutes of the grand jury proceeding is denied.
