| DECISION & ORDER ON MOTION |
Motion by the appellants Three Nickels, LLC, and Reifer Management Corp. to subpoena certain records in connection with appeals from an order of the Supreme Court, Kings County, dated June 14, 2011.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that on the Court's own motion, on or before March 20, 2012, the respondent's counsel shall file with the Clerk of this Court the records which were reviewed in camera by the Supreme Court, Kings County; those records shall be filed in this Court, under seal, for in camera review by the panel of Justices assigned to hear the appeal, and those records shall remain sealed upon filing; and it is further,
ORDERED that the motion is denied as academic.
