DECISION & ORDER ON MOTION

The People of the State of New York, Respondent, v
Paul Shannon, Appellant.

Motion by appellant to vacate an order of this court dated February 18, 2010, which dismissed an appeal from a judgment of conviction of the Criminal Court of the City of New York, Queens County, rendered July 10, 2009. Separate motion by appellant for leave to prosecute the appeal as a poor person and for the assignment of counsel.

Upon the papers filed in support of the motions and no papers having been filed in opposition thereto, it is

ORDERED, on the court's own motion, that appellant's motions are consolidated for the purpose of disposition; and it is further,

ORDERED that the motion to vacate the order of this court dated February 18, 2010 is granted and the appeal shall be perfected by May 4, 2012; and it is further,

ORDERED that in the event the appeal is not perfected on or before May 4, 2012, the court, on its own motion, may dismiss the appeal or respondent may move to dismiss the appeal on three days' notice; and it is further,

ORDERED that the motion for leave to prosecute the appeal as a poor person and the assignment of counsel is denied.
