The People of the State of New York, Respondent-Appellant, v Jeffrey T. Leone, Appellant.

Motion by the appellant to vacate an order of this court dated October 11, 2011, which dismissed an appeal from a a judgment of conviction of the First District Court of Nassau County rendered January 28, 2011.

Upon the papers filed in support of the motion and papers having been filed in response thereto, it is hereby,

ORDERED that the motion to vacate is granted and the court's order dismissing the appeal is vacated; and it is further,

ORDERED that on the court's own motion, the appellant's time to perfect the appeal is enlarged and appellant's brief shall be served and filed on or before May 16, 2012.
