| DECISION & ORDER ON MOTION |
Motion by the appellant on appeals from a judgment of the Supreme Court, Dutchess County, dated September 29, 2010, and an order of the same court also dated September 29, 2010, which were determined by decision and order of this Court dated November 15, 2011, inter alia, to stay enforcement of the judgment pending hearing and determination of the appellant's motion for leave to reargue the appeals, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this Court.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to stay enforcement of the judgment pending hearing and determination of the appellant's motion for reargument or leave to appeal to the Court of Appeals is denied as academic as that motion was determined by decision and order on motion of this Court dated February 2, 2012; and it is further,
ORDERED that the motion is otherwise denied.
