Appellant having moved for permission to perfect the appeal taken herein from an order of the Court of Claims entered in the Office of the Clerk of said court on May 6, 2011, without having to stipulate to the record,
Now, upon reading and filing the affidavits of Isaias Bermudez sworn to February 14, 2012, and February 28, 2012, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is dismissed on the ground that the appeal has been dismissed (see 22 NYCRR 1000.12 [b]).
