| DECISION & ORDER ON MOTION |
Motion by the respondent pro se on appeals from two orders of the Supreme Court, Westchester County, dated October 5, 2011, and December 19, 2011, respectively, a judgment of the same court dated December 19, 2011, and a decision of the same court dated November 29, 2011, for poor person relief and for the assignment of counsel.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the appeal from the decision dated November 29, 2011 (Appellate Division Docket No. 2012-00127), is dismissed, without costs or disbursements, on the ground that no appeal lies from a decision (see Schicchi v J.A. Green Constr. Co.,100 AD2d 509); and it is further,
ORDERED that the branch of the motion which is for poor person relief and for the assignment of counsel with respect to the appeal from the decision is denied as academic; and it is further,
ORDERED that the motion is otherwise denied.
ANGIOLILLO, J.P., DICKERSON, BELEN and HALL, JJ., concur.
