It is Ordered that the motion and cross motion are consolidated for disposition. It is further Ordered that landlord-appellant's motion to clarify is granted to the extent of directing landlord-appellant to remove respondent's May 2011 motion papers from the Record on Appeal and to serve and file the Amended Record on Appeal and appellant's brief for the June 2012 term - the filing deadline is April 10, 2012.
