DECISION & ORDER ON MOTION

Appeal by William Calandro from an order of the Family Court, Kings County, dated August 18, 2011. By decision and order on motion of this Court dated January 26, 2012, the appellant was directed to file an affidavit or affirmation containing certain information within 30 days after the date of the decision and order on motion, and was advised that if he failed to provide the affidavit or affirmation in accordance with the decision and order on motion, the Court, on its own motion, would dismiss the appeal without further notice. The appellant has not filed the affidavit or affirmation.

Now, on the Court's own motion, it is

ORDERED that the appeal is dismissed, without costs or disbursements, for failure to comply with the decision and order on motion dated January 26, 2012 (22 NYCRR 670.4[a]).
