| DECISION & ORDER ON MOTION |
Motion by the respondent on an appeal from an order of the Supreme Court, Suffolk County, dated February 25, 2011, inter alia, for leave to file a supplemental record containing a certain letter dated June 11, 2010.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to file a supplemental record containing the letter dated June 11, 2010, from Daniel Flanzig to James K. Hogan is granted and on or before April 16, 2012, the respondent shall serve and file a supplemental record containing that letter; and it is further,
ORDERED that the motion is otherwise denied.
