Motion by respondent for an enlargement of time to serve and file papers in response to the branch of appellant's prior motion seeking to vacate an order of this court dated February 18, 2010, which dismissed an appeal from a judgment of conviction of the Criminal Court of the City of New York, Queens County, rendered July 10, 2009, and in opposition to the branch of appellant's motion seeking leave to prosecute the appeal as a poor person and for the assignment of counsel.
Upon the papers filed in support of respondent's motion and the papers filed in opposition thereto, it is
