ORDER ON APPLICATION

Application by the nonparty-respondent Anthony A. Capetola and the plaintiff-respondent pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief on appeals from two orders of the Supreme Court, Nassau County, dated February 24, 2011, and March 7, 2011, respectively, two money judgments of the same court both dated May 5, 2011, and a money judgment of the same court entered June 20, 2011. Separate application, in effect, to enlarge the time to serve the appellant's appendix and the appellant's brief on the nonparty-respondent Robert G. Smith and to enlarge the time of the nonparty-respondent Robert G. Smith pursuant to 22 NYCRR 670.8(d)(2) to serve and file a brief.

Upon the papers filed in support of the applications, the papers filed in relation to the application by the nonparty-respondent Anthony A. Capetola and the plaintiff-respondent, and no papers having been filed in opposition or in relation to the separate application, it is

ORDERED that the applications are granted, the appellant's appendix and the appellant's brief are deemed timely served on the nonparty-respondent Robert G. Smith, and the respondents' time to serve and file their briefs is enlarged until May 1, 2012.
