Now, upon reading and filing the affidavit of Joseph Jackson sworn to January 24, 2012, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is dismissed as moot, and
It is further ORDERED that any request to strike the response filed by the People on January 24, 2012 is denied.
