Appellant having moved for permission to proceed as a poor person, assignment of counsel, an extension of time to perfect the appeal, and other relief on the appeal taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Erie on September 30, 2011,

Now, upon reading and filing the affidavit of David A. Burr sworn to March 7, 2012, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion insofar as it seeks permission to proceed as a poor person is denied on the ground that the facts set forth by appellant fail to demonstrate merit to the appeal, and

It is further ORDERED that the motion insofar as it seeks an extension of time to perfect the appeal is dismissed as premature (see 22 NYCRR 1000.13 [f]), and

It is further ORDERED that the motion is otherwise denied.
