| DECISION & ORDER ON MOTION |
Motion by the petitioner-appellant, in effect, for leave to reargue an appeal from an order and judgment (one paper) of the Supreme Court, Kings County, dated March 9, 2009, which was determined by decision and order of this Court dated October 18, 2011, and to waive the motion filing fee. Cross motion by the respondent-respondent to impose a sanction upon the petitioner-appellant and to preclude the petitioner-appellant from making further motions without prior leave of the Court.
Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to waive the motion filing fee is granted; and it is further,
ORDERED that the motion is otherwise denied; and it is further,
ORDERED that the branch of the cross motion which is to preclude the petitioner-appellant from making further motions without prior leave of the Court is granted; and it is further,
ORDERED that the cross motion is otherwise denied.
