DECISION & ORDER ON MOTION

The People of the State of New York, Appellant, v Brian Currid, Respondent.

Motion by appellant on appeal from an order of the Justice Court of the Village of Walden, Orange County, dated June 2, 2011, for an order deeming the allegations set forth in the affidavit of errors to be admitted for the purposes of the appeal or, in the alternative, to compel the Justice Court to file an amended return to appellant's affidavit of errors.

Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is

ORDERED that the motion is denied; and it is further,

ORDERED, on the court's own motion, that an enlargement of time to perfect the appeal is granted and the appeal shall be perfected by June 1, 2012.
