It is Ordered that defendant-appellant's motion is granted and he is directed to perfect his appeal by no later than the September 2012 term - the filing deadline is July 10, 2012. In the event that defendant-appellant perfects his appeal, plaintiff-respondent may raise its arguments regarding the timeliness of the notice of appeal in its respondent's brief.
