| DECISION & ORDER ON MOTION |
Howard Finkelstein was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on October 18, 1972. By opinion and order of this Court dated February 7, 2012, Mr. Finkelstein's resignation as an attorney and counselor-at law was accepted, he was disbarred, and his name was stricken from the roll of attorneys and counselors-at-law.
On the Court's own motion, it is
ORDERED that the opinion and order dated February 7, 2012, in the above-entitled proceeding is vacated by reason of the death of Howard Finkelstein on September 9, 2011.
