DECISION & ORDER ON MOTION

Motion by the Immigrant Defense Project for leave to file a letter as an amicus curiae supporting the defendant's application pursuant to CPL 450.15 and 460.15 for a certificate granting leave to appeal to this Court from an order of the County Court, Suffolk County, dated January 30, 2012, and to admit pro hac vice Dawn Seibert, an attorney in good standing in the State of Vermont, to represent it for purposes of the defendant's application.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to admit pro hac vice Dawn Seibert, an attorney in good standing in the State of Vermont, to represent the Immigrant Defense Project for purposes of the defendant's application is granted; and it is further,

ORDERED that the branch of the motion which is for leave to file a letter as an amicus curiae is granted to the extent that on or before May 15, 2012, if it be so advised, the Immigrant Defense Project may serve and file an affirmation or affidavit supporting the defendant's application, and that branch of the motion is otherwise denied; and it is further,

ORDERED that the parties, if they be so advised, may file reply affirmations or affidavits to the amicus curiae affirmation or affidavit within 10 days after service upon them of the amicus curiae affirmation or affidavit.
