DECISION & ORDER ON MOTION

Motion by Antwane Carlisle to extend his time to file a notice of appeal from an order of the Supreme Court, Westchester County, dated September 22, 2011, for poor person relief and for the assignment of counsel.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is to extend the time to file a notice of appeal is denied (see CPLR 5513); and it is further,

ORDERED that the motion is otherwise denied as academic.
