Motion by the petitioner-appellant to direct the nonparty-respondent to pay costs in the sum of $739.30, on an appeal from an order of the Supreme Court, Rockland County, dated July 8, 2010, which was determined by decision and order of this Court dated May 24, 2011.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is denied as academic as the nonparty-respondent has paid the petitioner-appellant costs in the sum of $739.30.
