Motion by the appellant, inter alia, to withdraw an appeal from an order of the Family Court, Kings County, dated July 5, 2011.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the motion is granted to the extent that the appeal is dismissed, without costs or disbursements, as the appeal abated upon the death of the appellant, on January 9, 2012 (see Matter of Mary Ellen C. v Joseph William C., 79 AD2d 1024), and the motion is otherwise denied.
