DECISION & ORDER ON MOTION

Appeal by Terrence Holland from an order of the Family Court, Suffolk County, dated November 1, 2011. By scheduling order dated February 3, 2012, the appellant was directed to perfect the appeal in the above-entitled proceeding within 60 days after receipt of the transcripts of the minutes of the proceedings in the Family Court. On or about February 22, 2012, the appellant advised the Court that he had received the transcripts on February 14, 2012. The appellant has not perfected the appeal.

Now, on the Court's own motion, it is

ORDERED that the appeal is dismissed, without costs or disbursements, for failure to comply with the scheduling order dated February 3, 2012, issued pursuant to § 670.4(a)(2) of the rules of this Court (22 NYCRR 670.4[a][2]).
