The People of the State of New York, Respondent, v Richard Brachman, Appellant.

Motion by the appellant to vacate an order of this court dated September 13, 2011, which dismissed an appeal from a judgment of conviction of the Justice Court of the Town of Monroe, Orange County rendered July 14, 2009.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is hereby,

ORDERED that the motion to vacate is granted and the court's order dismissing the appeal is vacated; and it is further

ORDERED, on the court's own motion, that appellant's time to perfect the appeal is enlarged and appellant' s brief shall be served and filed on or before July 6, 2012.
