| DECISION & ORDER ON MOTION |
Motion by the appellant on appeals from three orders of the Supreme Court, Suffolk County, dated July 20, 2009, April 8, 2010, and May 11, 2010, respectively, inter alia, to strike stated portions of the respondent's brief on the ground that they refer to matter dehors the record and to waive the motion filing fee.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is to waive the motion filing fee is denied as academic as the motion filing fee has been paid; and it is further,
ORDERED that the motion is otherwise denied.
