DECISION & ORDER ON MOTION

Motion by Rachel J. Filasto, counsel assigned to represent the appellant on an appeal from an amended judgment of the County Court, Westchester County, rendered June 20, 2011, to be relieved, on the ground that the appellant has abandoned the appeal, by failing to respond to correspondence sent to him by assigned counsel. Cross motion by the respondent to dismiss the appeal for failure to timely perfect.

Upon the papers filed in support of the motion and the papers filed in relation thereto, and upon the papers filed in support of the cross motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion and cross motion are granted, assigned counsel is relieved, and the appeal is dismissed (see 22 NYCRR 670.8[f]; CPL 470.60[1]).
