It is Ordered that the motion and cross motion are consolidated for disposition. It is further Ordered that plaintiffs-respondents' motion is denied and defendants-appellants' cross-motion is granted on condition that defendants-appellants perfect their appeal by no later than the October 2012 term - the filing deadline is August 8, 2012. In the event defendants-appellants fail to comply with the foregoing condition, plaintiffs-respondents may move, on five days' notice, for an order dismissing the appeal.
