Motion by the respondent to dismiss an appeal from an order of the Family Court, Westchester County, dated November 17, 2011, for failure to timely serve the notice of appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that on the Court's own motion, the notice of appeal, which was timely filed, is deemed timely served (see CPLR 5520[a]); and it is further,
ORDERED that the motion is denied.
