DECISION & ORDER ON MOTION

Motion by respondent on an appeal from orders of the Civil Court of the City of New York, Kings County, dated February 11, 2011 and February 24, 2011, to vacate a stay granted by decision and order of this court dated June 6, 2011 and continued by decision and order of this court dated August 22, 2011, and to dismiss the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied on condition that the appeal be perfected by August 3, 2012; and it is further,
ORDERED that in the event that the above condition is not met, the court, on its own motion, may vacate the stay, or respondent may move to vacate the stay on three days' notice.
