DECISION & ORDER ON MOTION

Motion by the appellant to stay enforcement of an order of the Supreme Court, Nassau County, dated February 22, 2012, pending hearing and determination of an appeal therefrom.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted to the extent that enforcement of so much of the order dated February 22, 2012, as directed the appellant to pay to the respondent counsel fees in the sum of $156,000 pay the sum of $225,000 to the respondent, and pay the sum of $25,000 to the subject "529" account and directed the appellant's incarceration is stayed pending hearing and determination of the appeal on condition that (1) the appeal is perfected on or before July 9, 2012, and (2) the appellant continues to pay the sums of $1,733 per month as maintenance and $4,767 per month as child support in accordance with the order dated February 22, 2012, and the motion is otherwise denied; and it is further,

ORDERED that in the event that the appellant does not comply with the foregoing conditions, the Court, on its own motion, may vacate the stay, without further notice, or the respondent may move to vacate the stay, on three days notice.
