| DECISION & ORDER ON MOTION |
Motion by the respondent on an appeal from an order of the Supreme Court, Kings County, dated August 24, 2010, inter alia, in effect, to clarify a decision and order on motion of this Court dated May 11, 2011, which granted the appellant's motion for a stay, by adding a provision thereto that their application to the Supreme Court, Kings County, for a hearing on a proposed settlement pursuant to CPLR 1207, is not stayed.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is denied as unnecessary as the decision and order on motion of this Court dated May 11, 2011, stayed only the trial in the above-entitled action pending hearing and determination of the appeal.
