DECISION & ORDER ON MOTION

Appeal by Darnell Warren from a resentence of the Supreme Court, Kings County, imposed May 15, 2009. By order to show cause dated May 1, 2012, the appellant was directed to show cause before this Court why an order should or should not be entered dismissing the appeal as abandoned and deeming the appellant's motion for reargument of his prior motion for poor person relief and for the assignment of counsel withdrawn.

Now, upon the order to show cause and no papers having been filed in response thereto, it is

ORDERED that the motion to dismiss the appeal and to deem the motion for reargument abandoned is granted, and the appeal is dismissed (see 22 NYCRR 670.4[f]).
