ORDERED that the appeal is dismissed on the ground that subsequent to the entry of the order appealed from, the Civil Court, by order entered May 29, 2012, granted a motion by respondent for summary judgment, rendering this appeal moot (see Livny v Rotella, 305 AD2d 377 [2003]; Sigma Psychological, P.C. v Chubb Indem. Ins. Co., 34 Misc 3d 156[A], 2012 NY Slip Op 20412[U] [App Term, 2d, 11th & 13th Jud Dists 2012]).
