ORDERED that this court's decision and order on motion dated June 1, 2012 in the above-captioned matter, which denied a motion by appellant for leave to appeal to the Appellate Division from a decision and order of this court dated April 4, 2012, which decision and order determined an appeal from a final judgment of the Civil Court of the City of New York, Kings County, entered October 19, 2010, is amended by adding the sentence "Golia, J., taking no part." following the decretal paragraph.
