| DECISION & ORDER ON MOTION |
Application by the appellant on an appeal from a judgment of the County Court, Dutchess County, rendered May 6, 2010, pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief, as directed by decision and order of this Court dated February 14, 2012.
Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the application is granted and the appellant's brief submitted to the Clerk of the Court is accepted for filing and deemed timely served; and it is further,
ORDERED that on the Court's own motion, the respondent's time to serve and file a brief is enlarged until July 20, 2012, and the respondent's brief must be served and filed on or before that date.
