DECISION & ORDER ON MOTION

Motion by the appellant to enlarge the time to perfect an appeal from a judgment of the County Court, Suffolk County, rendered March 21, 2011, and to direct the Clerk of the Court to subpoena the original papers and to subpoena the trial exhibits from the respondent.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is to enlarge the time to perfect the appeal is granted, and the appellant's time to perfect the appeal is enlarged until October 1, 2012; and it is further,

ORDERED that the branch of the motion which is to direct the Clerk of the Court to subpoena the original papers is granted, and the Clerk of the Court, or her designee, shall subpoena the original papers from the Clerk of the County Court, Suffolk County; and it is further,

ORDERED that the branch of the motion which is to direct the Clerk of the Court to subpoena the trial exhibits is denied; and it is further,

ORDERED that on the Court's own motion the respondent shall file the trial exhibits with the Clerk of this Court on or before August 10, 2012.
