| DECISION & ORDER ON MOTION |
Motion by the appellant on an appeal from a judgment of the County Court, Suffolk County, rendered December 10, 2009, to enlarge the judgment roll to include the respondent's response to a demand for discovery and bill of particulars dated March 20, 2008, and the respondent's letter dated July 21, 2008.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the branch of the motion which is to enlarge the judgment roll to include the respondent's response to a demand for discovery and bill or particulars dated March 20, 2008, is denied as unnecessary as that document is properly part of the judgment roll; and it is further,
ORDERED that the appellant shall file the respondent's response to a demand for discovery and bill of particulars dated March 20, 2008, as original papers with the Clerk of this Court on or before July 30, 2012; and it is further,
ORDERED that the motion is otherwise denied.
