| DECISION & ORDER ON MOTION |
Motion by the respondent on an appeal from a judgment of the County Court, Suffolk County, rendered September 15, 2009, to enlarge the judgment roll to include the transcript of the arraignment proceedings which occurred on November 5, 2008. Application by the respondent pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion and application are granted, the respondent's time to serve and file a brief is enlarged until August 13, 2012, and on or before that date, the respondent shall serve and file a brief and shall file the transcript of the arraignment proceedings which occurred on November 5, 2008, with the Clerk of the Court.
