Motion by appellant for leave to serve and file an amended brief on an appeal from an order of the Civil Court of the City of New York, Richmond County, dated January 11, 2011.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the motion is granted, appellant's original brief is stricken, and appellant is directed to serve and file an amended appellant's brief within 21 days from the date of this decision and order; and it is further,
ORDERED that respondent's original brief is stricken and, if he be so advised, respondent may serve and file an amended respondent's brief within 21 days after appellant's amended brief is served; and it is further,
ORDERED that appellant, if it be so advised, may serve and file a reply brief within 14 days after respondent's amended brief is served.
