Appeal by Rory Gregory and Leonard M. Morrison from an order of the City Court of New Rochelle, Westchester County, entered February 28, 2011, and appeal by Leonard M. Morrison from an order of the same court entered September 22, 2011.
On the court's own motion, it is
ORDERED that so much of the appeal from the order entered February 28, 2011 as was taken by appellant Rory Gregory is dismissed, as the action, insofar as asserted against him, was settled in the City Court on May 13, 2011, rendering that portion of the appeal from the order entered February 28, 2011 moot.
