DECISION & ORDER ON MOTION

Motion by appellant on an appeal from a judgment of the Civil Court of the City of New York, Queens County, entered August 7, 2009, for an order directing respondent to furnish appellant with a copy of the trial exhibits and for an enlargement of time to serve and file a reply brief. Separate motion by appellant for an order directing the Clerk of this court to provide him without fee a copy of the trial exhibits and for an enlargement of time to serve and file a reply brief. Separate motion by appellant for an enlargement of time to serve and file papers in reply to respondent's opposition to appellant's motion for an order directing respondent to furnish appellant with a copy of the trial exhibits and for an enlargement of time to serve and file a reply brief, and, in effect, for leave to withdraw his motion to compel the Clerk of this court to provide him without fee a copy of respondent's trial exhibits.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED, on the court's own motion, that appellant's motions are consolidated for purposes of disposition; and it is further,

ORDERED that the branch of appellant's motion seeking an enlargement of time to serve and file papers in reply to respondent's opposition to appellant's motion for an order directing respondent to furnish appellant with a copy of the trial exhibits and for an enlargement of time to serve and file a reply brief is granted and the reply papers are deemed timely served and filed; and it is further,
ORDERED that the branch of appellant's motion seeking, in effect, leave to withdraw his motion to compel the Clerk of this court to provide him without fee a copy of respondent's trial exhibits and for an enlargement of time to serve and file a reply brief is granted ,and said motion is marked withdrawn; and it is further,
ORDERED that appellant's motion for an order directing respondent to furnish appellant with a copy of the trial exhibits and for an enlargement of time to serve and file a reply brief is denied.
