Motion by respondent to dismiss an appeal from an order of the Justice Court of the Town of Pelham, Westchester County, entered October 14, 2010, and a judgment of the same court entered May 13, 2011, for failure to prosecute.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the motion is granted and the appeal is dismissed.
We note that four months have elapsed since the death of appellant Helena Greene without the substitution of a personal representative (see CPLR 1021).
