DECISION & ORDER ON MOTION

Motion by the appellant 1733 51st Development, LLC, to enlarge the time to perfect its appeal from an order of the Supreme Court, Kings County, dated July 25, 2011.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that on the Court's own motion, the appeal by the appellant Eva Friedman is dismissed, without costs or disbursements, for failure to timely perfect (see 22 NYCRR 670.8[e]); and it is further,

ORDERED that the motion is granted, the time of the appellant 1733 51st Development, LLC, to perfect its appeal is enlarged until September 10, 2012, and the record or appendix on the appeal and the brief of the appellant 1733 51st Development, LLC, must be served and filed on or before that date; and it is further,

ORDERED that no further enlargement of time shall be granted.
