DECISION & ORDER ON MOTION

Motion by the appellant, inter alia, to strike stated portions of the respondent's brief and the addendum to the respondent's brief on appeals from two orders of the Supreme Court, Queens County, dated April 18, 2011, and April 20, 2011, respectively, and to enlarge the time to serve and file a reply brief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to strike stated portions of the respondent's brief and the addendum to the respondent's brief is held in abeyance and referred to the panel of Justices hearing the appeal for determination upon the argument or submission thereof; and it is further,

ORDERED that the branch of the motion which is to enlarge the appellant's time to serve and file a reply brief is denied as unnecessary as the reply brief was timely served and filed on June 29, 2012; and it is further,

ORDERED that the motion is otherwise denied.
