| DECISION & ORDER ON MOTION |
Motion by the appellant, in effect, to hold in abeyance an appeal from a judgment of the Supreme Court, Kings County, rendered April 20, 2011, pending the determination of a CPL 440 motion by Supreme Court, Kings County, or to enlarge the time to perfect the appeal.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the branch of the motion which is, in effect, to hold the appeal in abeyance is denied; and it is further,
ORDERED that the branch of the motion which is to enlarge the time to perfect the appeal is granted, and the appellant shall perfect the appeal expeditiously in accordance with this Court's rules (see 22 NYCRR 670.1, et seq.) and written directions.
