Motion by respondent on an appeal from a final judgment of the Civil Court of the City of New York, Kings County, entered October 19, 2010, to direct the release of funds on deposit. Separate motion by appellant for an extension of time to serve and file papers in opposition to respondent's motion and to serve and file a "cross motion."
Upon the papers filed in support of the motions and the papers filed in opposition to appellant's motion, it is
ORDERED that respondent's motion is granted and the New York City Department of Finance is directed to release the funds on deposit in this matter to respondent 741 E. 3rd, LLC, less any lawful fees; and it is further,
ORDERED that appellant's motion is denied.
