DECISION & ORDER ON MOTION

Motion by the appellant pro se on an appeal from an order of the Supreme Court, Kings County, dated October 15, 1997, which was determined by decision and order dated December 14, 1998, for leave to make a motion for leave to appeal to the Court of Appeals from the decision and order of this Court, and, upon granting leave to make the motion, for leave to appeal to the Court of Appeals.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to make a motion is granted; and it is further,

ORDERED that the branch of the motion which is for leave to appeal to the Court of Appeals is denied.
