DECISION & ORDER ON MOTION

Motion by the respondent, inter alia, to vacate an opinion and order of this Court dated March 27, 2012. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on July 23, 2003. By opinion and order of this Court dated March 27, 2012, this Court suspended the respondent from the practice of law for a period of six months, effective April 30, 2012, based on his conviction for petit larceny. By a temporary restraining order contained in an order to show cause dated April 30, 2012, this Court stayed the suspension order, pending determination of the motion to vacate, on condition that the respondent "shall refrain from taking on any new legal matters or making any appearances in court on any existing matters and shall act in his capacity as an attorney only for the purpose of winding down his law practice."

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.
