DECISION & ORDER ON MOTION

Motion by the appellant for leave to reargue his application for a writ of error coram nobis to vacate, on the ground of ineffective assistance of appellate counsel, a decision and order of this Court dated October 15, 2001 (People v Merchant, 287 AD2d 580), affirming a judgment of the County Court, Nassau County, rendered June 29, 2000, which was determined by decision and order of this Court dated February 14, 2012.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.
