| DECISION & ORDER ON MOTION |
Motion by the respondent to dismiss appeals from three orders of the Supreme Court, Queens County, dated January 24, 2011, June 10, 2011, and September 6, 2011, respectively, on the ground that they have been rendered academic, and with respect to the appeals from the orders dated January 24, 2011, and September 6, 2011, on the further ground that they were untimely taken, or, in the alternative, to enlarge the record to include a certain order to show cause dated October 3, 2011. Application by the appellant to enlarge the time to serve and file a reply brief.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the papers filed in support of the application and no papers having been filed in opposition or relation thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that the application is granted, the appellant's time to serve and file a reply brief is enlarged until August 20, 2012, and the appellant's reply brief must be served and filed on or before that date.
